How To Die Happy Retreats terms and conditions
Welcome to How To Die Happy Retreats. We are dedicated to ensuring you have a transformative and enriching experience with us. These terms and conditions (made freely available on our website) outline the agreement between you (the Participant) and How To Die Happy Retreats (the Organiser), during our retreats (the Retreat Experience).
Retreat bookings
A 50% deposit is required to secure your retreat space. Please note that deposits are non-refundable and non-transferable if paid less than eighty (80) days before the retreat's commencement.
The remaining 50% must be paid ninety (90) days before the retreat commencement date. These remainder payments are also non-transferable and non-refundable.
Furthermore, payment is required in full for bookings made less than ninety (90) days before.
Please refer to our cancellation policy below for bookings made more than eighty (80) days in advance.
Failure to submit your remainder payment by the specified date may result in the release of your reservation to another eager participant.
In compliance with the laws of each retreat location, we kindly request a copy of an official identification document (Passport or Identification card) before your arrival.
To ensure a seamless experience, all How To Die Happy Retreat participants must complete a health form at least eighty (80) days before the retreat (unless you’re booking last-minute).
Cancellation policy
We understand that plans may change, which is why we offer a cancellation policy:
For cancellations made more than eighty (80) days before the retreat's commencement, a 25% deposit non-refundable charge will be applied, with the remainder thoughtfully converted into a voucher which can be used towards the total value (valid for one year). This voucher can be used for a future retreat with us, ensuring your well-being journey continues.
Cancellations within eighty (80) days of the retreat start date will result in the forfeiture of the entire 50% deposit. The remaining 50% will be thoughtfully converted into a voucher which can be used towards the total value (valid for one year).
The full reservation amount will be applicable for cancellations within thirty (60) days of the retreat start date.
Please be mindful that if you arrive late or need to leave the retreat early, no refunds will be granted for the remaining duration of your scheduled stay. Our commitment to curating a harmonious experience may lead us to dismiss any participant whose behaviour disrupts the retreat, and any potential refunds will be determined solely by the Organiser. Regrettably, we cannot offer refunds for travel, meals, or accommodation packages.
Payment & reservation conditions
At How To Die Happy Retreats, we offer two convenient payment options: online payment through our website or direct bank transfer. Upon booking your retreat, you will receive a confirmation email from us, which includes instructions for securing your reservation with a 50% prepayment. Payment methods include debit or credit cards (Visa or Mastercard with 3D secure active) or a straightforward bank transfer. The Participant is responsible for any bank transfer fees. If you require an invoice, please inform us during the booking process.
Child policy
Please note that How To Die Happy Retreats is exclusively designed for adults seeking transformation and rejuvenation. As such, we do not accommodate children.
Meals
Our culinary offerings at How To Die Happy Retreats celebrate nourishing vegetarian cuisine. We source our ingredients primarily from the retreat locations' farms or neighbouring farms. Meal schedules will be shared in advance.
Opt-in and opt-out marketing and newsletters
You can receive updates, information, and promotions via email when providing your personal information and subscribing to our newsletter. Rest assured, this choice is voluntary and can be revoked at any time. Unsubscribe easily, or reach out to us directly. We will promptly confirm your preferences to ensure you receive only the information that resonates with you.
Liability and indemnity
By participating in our retreat, you acknowledge that How To Die Happy Retreats and its representatives shall not be held responsible for any personal injuries, property damage, or other losses that may occur during the retreat. You agree to indemnify and hold How To Die Happy Retreats harmless from any claims arising out of your participation in the retreat.
Waiver of liability, indemnity, and release
In consideration for participating in the Retreat Experience, you, and you on behalf of your executors, administrators, heirs, successors, assign voluntarily assume full responsibility for and hereby release, waive, discharge, hold harmless, and covenant not to sue the Organiser, its officers, members, agents, contractors, employees, volunteers, guides, and other representatives (each an "Organiser Party" and collectively, the "Organiser Parties") for any and all claims, demands, actions, causes of action, and/or losses (including but not limited to any exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages, medical expenses, lost wages/income, loss of services, lost profits, property damage, pain, illness, and death) (collectively "Liabilities") whatsoever arising out of or in any way related to your travel to and/or participation in the Retreat Experienceand/or any activities conducted in connection therewith, regardless of whether such liabilities are caused by the negligence of any Company Party or otherwise, and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, even if any Organiser Party has been advised of the possibility of such.
Modification/cancellation
For further clarification: on reservation, you will pay a non-refundable deposit in the sum identified at the time of reservation (50%). You will pay the remainder of the balance ninety (90) days before the Retreat Experience start date. If the Retreat Experience you are booking takes place less than ninety (90) days before the start date, the price of the Retreat Experience is to be paid in full.
The Organiser reserves the right to make changes to any and all aspects of the Retreat Experience (which may include without limitation, changes to the types and/or timing of activities available during the Retreat Experience, items and/or services included with the Retreat Experience, the itinerary, and/or the nature of the Retreat Experience classes) if, in the Organiser's sole discretion, the Organiser deems it necessary to do so due to the availability of third-party suppliers ("Suppliers"), weather conditions, conditions that may be hazardous, dangerous, or otherwise adverse or threatening, other circumstances out of the Organiser's control, or for any other reason considered commercially necessary by the Organiser. The Participant will not be eligible for any refunds of any amount based on any such changes to the Retreat Experience.
The Organiser reserves the right to cancel the Retreat Experience at any time prior to the start date for any reason in the Organiser's sole discretion. If possible, in such an event, you will be offered a new retreat date within one hundred and eighty (180) days. If this date is unacceptable, you will receive a full refund of the amount you remitted to the Organiser, but in no event will the Organiser be responsible for any other amount, including preparation costs, airfare, travel documents, or any other Losses.
Insurance
The Organiser strongly recommends purchasing appropriate travel insurance for the Retreat Experience. You are solely responsible for the cost of any travel insurance and ensuring that you are adequately insured for the entire duration of the Retreat Experience concerning possible illness (including any issues relating to COVID or COVID "vaccines"), injury, death, property damage, loss of baggage and personal items, cancellation and/or curtailment, and/or any other potential losses, damages, costs, expenses, or liabilities (collectively "Losses"). You will be solely responsible for any Losses related to your failure to procure travel insurance. The Organiser is not liable for ANY Losses you incur and/or sustain.
Photos, video, other media
The Organiser has all rights to use, reproduce, display, exhibit, publish, distribute, and/or produce derivative works based on your image, likeness, and voice as recorded by any camera and/or on any video, audio, and/or other media (collectively, "Likeness") worldwide, in perpetuity, without compensation, payment, or other additional consideration of any kind, for any lawful purpose, including without limitation for marketing and trade purposes. Please inform the Organiser should you not agree that your Likeness may be used, reproduced, displayed, exhibited, published, edited, or distributed by the Organiser at its sole discretion. You understand that your Likeness may be used in various publications, promotional or marketing materials, and/or social media, unrestricted by time or geographic area and consent to such uses.
You hereby waive the right to inspect or approve any and all materials in which your Likeness may appear. You further waive any right to royalties or other compensation arising or related to the use of your Likeness. This release applies to all photographic, audio, and/or video recordings collected as part of, in connection with, and/or during the Retreat Experience (by the Organiser or any third party).
Voluntary participation in strenuous activity
You acknowledge that you are voluntarily participating in the Retreat Experience, which may include strenuous physical activity, including, without limitation, walking, running, hiking, kayaking, dancing, swimming, yoga, breathwork, energy exercises, body movement, plant medicine consumption, and various other exercises or physical activity as part of Retreat classes or activities ("Physical Activity"). You acknowledge that you are fully aware of the risks and hazards connected with participation in the Retreat Experience and/or engaging in Physical Activity, which may include the risk of serious injury (e.g., heart attacks, muscle strains, pulls, tears, broken bones, shin splints, and other illnesses) or death. You hereby elect to voluntarily participate in such Physical Activities as part of the Retreat Experience.
Health and fitness eligibility
You represent that you are over 18 years old or have the full consent to attend the Retreat Experience by a legal parent or guardian over 18 years old.
You represent that you are healthy, in good physical and mental health, and are fully capable of participating in the Retreat Experience. You further represent that you do not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude your participation in the Retreat, including any Physical Activities.
You have discussed and addressed any questions or concerns you may have about your physical or mental health with the appropriate health care professional prior to the Retreat Experience start date, and documentation from your physician confirming your clearance to participate in the Retreat can be provided upon request.
If, at any time, you have any doubts about your physical condition or fitness to participate in any aspect of the Retreat Experience, you will cease participation in the same and seek appropriate medical attention.
The Organiser reserves the right in their sole discretion to refuse your participation in the Retreat Experience, any Retreat Experience classes, Physical Activities, and/or any other activities due to medical, fitness, or if at any time you demonstrate behaviour that may result in injury to yourself or others.
You understand and agree that if you are pregnant, you will take the necessary steps to ensure your doctor and health care providers know you are participating in the Retreat Experience. You assert that you are of good health to participate in the Retreat Experience and will alert the fact of your pregnancy to the Organiser and any Suppliers in whose sessions you participate.
Assumption of risk
You understand that serious accidents may occur during Physical Activities, including, without limitation, yoga and kayaking, hiking, plant medicine consumption, cold plunge therapy/wild swimming, and that Participants can sustain fatal and/or serious personal injury. You agree to solely and exclusively assume full and complete responsibility for the risks inherent in travel and engaging in Physical Activity, which may include injury, death, property damage, and/or any other kind of Liability which may occur during the Retreat Experience.
Injury
In the event you are injured while participating in the Retreat Experience, you agree to assume all financial obligations for any and all medical costs you incur. You acknowledge and agree that in no event shall the Organiser be liable or responsible for any losses or liabilities arising from your participation in the Retreat Experience.
Medical care
In the event that you should require medical care or treatment, you agree to be financially responsible for any costs incurred as a result of such treatment. You are aware and understand that you should carry your own health insurance.
Although you acknowledge that there is no obligation of any person to provide any Participant with medical care during, prior to, or after a Retreat Experience, in the event that necessary medical treatment is provided, you hereby consent to such care. This release shall apply to all medical care.
The Organiser is not a medical practitioner, and the Retreat Experience is not a provider of medical services.
Personal property
You acknowledge and agree that you are responsible for your equipment and all personal property during the Retreat Experience and that the Organiser or any Suppliers or third parties are not responsible in any way for your property, whether it is lost, stolen, or damaged.
Retreat property
In the event that any damage to equipment or facilities of either the Host, Organiser, or any Supplier occurs as a result of your willful actions, neglect or recklessness, you acknowledge and agree to be held liable for any and all costs associated with any acts of negligence or recklessness.
Force majeure
If the Organiser is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of any Act of God, strike, trade dispute, fire, inclement weather, breakdown, pandemic or any other health crisis, alien invasion, interruption of transportation networks/means, government or political action, acts of war or terrorism, acts or omissions of a third party, or for any other cause whatsoever outside of the Organiser's reasonable control, the Organiser will be under no liability whatsoever to you and may, at the Organiser's sole discretion, by written notice to you, either cancel the Retreat Experience or take any other reasonable action.
Rules and respect
The Participant agrees to abide by all rules and regulations presented by the Host, Organiser, and any Suppliers and treat all and fellow participants with a high level of courtesy and respect for the mutual benefit of all participants.
